Key points of the sheet

  1. The Declaration of the Rights of Man and of the Citizen and the other fundamental texts give us many rights and freedoms. But these rights have a limit to protect life in society.
  2. Our rights are "imprescriptible" (imprescriptibles) (article 2 of the DDHC). This means they cannot be taken away from us.
  3. Our freedoms are limited by the rights of others. Freedom means doing anything that does not harm others (article 4 of the DDHC).
  4. Our rights and freedoms are limited by the general interest, the freedoms of others and respect for human dignity.
  5. They are also limited by the defence of public order. Public order covers safety, peace and quiet, and public health and hygiene (salubrité).
  6. To fight terrorism, some freedoms, for example freedom of movement, were restricted. In March 2020, the health state of emergency against Covid-19 limited the freedom to come and go, to run a business and to meet.
  7. In prison, freedom of correspondence can be restricted for safety or to keep order. It is forbidden to move around in public spaces wearing clothing meant to hide the face.
